It addresses the procedural effects of the rule inscribed in article 5, item LVII, of the Federal Constitution, under tripartite bias, which is the rule of treatment, evidentiary rule and rule of law. It will be demonstrated that the relativization of the presumption of innocence is reasonable, proportional and constitutional, based on the legitimacy of constitutional jurisdiction, within the limits delineated by the legal and jurisprudential balances established in international laws and treaties. It will be demonstrated that mitigation of the right to liberty does not offend the essential core of the presumption of innocence. O objetivo desse artigo, constituindo-se de uma pesquisa do tipo qualitativa, com métodos hipotético-dialético e dedutivo, utilizando a técnica de pesquisa doutrinária, legislativa e jurisprudencial, é debater a presunção de inocência na legislação comparada, nos tratados internacionais e no direito brasileiro.  Aborda os efeitos processuais da norma insculpida no artigo 5º, inciso LVII, da Constituição Federal, sob viés tripartido, qual seja regra de tratamento, regra probatória e regra de juízo. Demonstrar-se-á que a relativização da presunção de inocência é razoável, proporcional e constitucional, fundada na legitimidade da jurisdição constitucional, nos limites delineados pelas balizas legais e jurisprudenciais constantes das leis e tratados internacionais. Demonstrar-se-á que a mitigação do direito à liberdade não ofende o núcleo essencial do princípio da presunção de inocência.
