Its application in special procedures is contemplated considering the sufficiency of the evidentiary activity required to distort the effects of the presumption in favor of the administered. El presente artículo explica y analiza los alcances de la presunción de licitud en el marco del ejercicio de la potestad sancionadora de la Administración Pública, desde su vinculación y sustento con la presunción de inocencia, así como sus efectos en el desarrollo de los procedimientos administrativos sancionadores, con especial incidencia en la carga de la probanza de los hechos y la participación del presunto infractor en los mismos. Se contempla su aplicación en los procedimientos especiales considerando la suficiencia de la actividad probatoria requerida para desvirtuar los efectos de la presunción inicial a favor del administrado.
